How to delink your Aadhaar from Bank, Mobile Number, E-wallets

The Supreme Court has been declared the Section 57 of the Aadhaar Act as unconstitutional so banks, e-wallet and mobile operators are no longer eligible to use or ask Aadhaar number of their respective customers. 

but the people who have already linked their Aadhaar number with bank accounts and mobile numbers may delink it. many banks have already started the process and allowing customers to delink Aadhaar number from their account numbers. Others will have to follow the suit post the judgement by the Supreme Court. 

According to the "Compendium of Regulations, Circulars and Guidelines" for authentication of Aadhaar-based e-KYC, available on the official website of UIADI (Unique Identification Authority of India), an Aadhaar number holder is entitled to delink his biometric details shared with any authorised agency or service provider.

The compendium says, "The Aadhaar number holder may, at any time, revoke consent given to a KUA for storing his e-KYC data or for sharing it with third parties, and upon such revocation, the KUA shall delete the e-KYC data and cease any further sharing."

This means an Aadhaar card holder is legally allowed to delink her biometric identification details from bank accounts and mobile phone numbers.

Aadhaar delinking can be done by submitting an application to the branch of the bank where the customer has an account stating the reason for revoking her consent. A similar application can be submitted to concerned telecom operator for Aadhaar delinking.

Visit official website of your bank, e-wallet or mobile services provider. Login to your account and in your personal details or profile, find the option to de-link your Aadhaar number from the account. Once de-linked you will receive an SMS confirming the same.

The Scam Revealed

PNB has filed a complaint with the Central Bureau of investigation, mentioned that they have detected the fraudulent issuance of Letter of Undertakings (LOU) in Mid Corporate Branch, Brady House, Mumbai

when the Partnership firms M/s Diamond R US, Solar Exports, and Stellar Diamonds Partner named Mr. Nirav Modi,  Nishal Modi (Brother), Mrs. Ami Modi (Wife) and Mehul Choksi (Uncle)

contacted the Bank with export documents and asked for Buyer’s Credit to pay the dues of Overseas suppliers.but there was no Loan limit sanctioned in the name of these firms so the bank officers asked them to furnish 100% cash Margin money for buyer’s credit issuance against the Letter of Undertakings. And the Firms replied that they have availed the same facility earlier. but bank found that there is no such records.
Later the Bank officials found that two bank Employees had issued the buyer’s credit without following the standard procedure and the required approval. the accused employees had transmitted the SWIFT instructions to the foreign branches for Issuing the Buyer’s Credit and they have not entered the same in bank records so that the fraud can’t be detected easily

Buyer’s Credit is a short-term loan facility provided to Importers by Banks.In buyer's credit bank provides credit to the importer and a financial entity located the exporter’s country for Loan guaranty

Delhi high court declared that Sex 377 was unconstitutional In 2009, This decision was based on possible violations of Article 14 (equality before law), Article 15 (protection from discrimination) and Article 21 (protection of life and liberty) of the Indian constitution.

But In 2013, A Supreme court bench headed by justices G S Singhvi and S J Mukhopadhaya changed the Delhi high court's verdict given in 2009 which decriminalized gay sex among consenting adults in private.

This had bench allowed the appeals filed by several social and religious outfits challenging the high court verdict so that gay sex is against the cultural and religious values of India.

The bench had asked the Parliament to take a decision on this controversial issue, stating that the legislature should debate and decide on the matter. thus the apex court verdict, the operation of penal provision against gay sex has come into force.

Later The Supreme Court heard it in an open court on February 2, 2016 on a curative petition filed by LGBT activists challenging the verdict criminalising homosexuality in the country.

A curative petition is the last judicial remedy for redressal of grievances in court which is normally decided by judges in-chamber. In rare cases, such petitions are given an open court hearing.

The Fodder Scam ( चारा घोटाला ) was a corruption scandal that involved the Fraudulent withdrawal of  ₹9.4 billion from the government treasury of  Bihar. Accused in the theft and arrested were Former CM of Bihar, Lalu Prasad Yadav, Jagannath Mishra (former CM). This scam finished Lalu's regime as Chief Minister.Shivanand Tiwari was allegedly received 1.6 crore Rupees from S.N. Sinha.

The Fodder Scam case was for many years and it allegedly involved a number of Bihar state's administrative and elected officials from multiple administrations of the Congress and the Janata Dal. The Fodder Scam involved the illegal withdrawal of money for fictitious livestock for fodder, medicines and animal husbandry equipment.
The Fodder Scam exposed in 1996, the Loot was in progress and increased for over two decades.Besides the gravity and duration of the Loot, the scam was and Literally covered in
Indian media because of the Big nexus between served bureaucrats, politicians, and businessmen.
It was an example of the mafia raj which has affected many economic public sectors in India.

the trial was completed in 44 cases out of a total of 53 cases in May 2013,.Over 500 accused was convicted and punished by several courts.

Origin of  the Fodder Scam

Initially, it was a small case of small-scale loot by few government employees who were submitting false expense reports, Later it grew up in size and additional factors added in it, politicians and businesses, over time, and become a full-fledged mafia system. Jagannath Mishra, who was the chief minister of Bihar in 1970, was the first chief minister to be accused of involvement in the scam.

The Former Comptroller and Auditor General (CAG) T.N. Chaturvedi, had noticed the delayed monthly account statement submissions by the Treasury and departments of Bihar and he wrote to the former Bihar chief minister, Chandrashekhar Singh, warned him that it seems a  temporary embezzlement.This incident had started the consistency closer scrutiny and warnings by Principal Accountant Generals (PAGs) and CAGs to the government of Bihar during the tenures of many chief ministers from many political parties but everyone had ignored the warnings that exposed a pattern by most senior political and bureaucratics of the Bihar government.
Anti Corruption Unit Inspector Bidhu Bhushan Dwivedi submitted a report in 1992, exposed The Fodder Scam and the possible involvement of Key elements like the chief ministers to the director general of the same vigilance unit, G. Narayan. In result, Inspector Bidhu Bhushan Dwivedi was transferred from the vigilance unit to the other branch of the administration and Later suspended from his Post. further, He was a witness in corruption cases relating to the scam went to trial and reinstated by order of the Jharkhand High Court.
